Summary

This session will discuss the ethical considerations surrounding the creation and use of audio and video recordings of witnesses.  Topics will include the ethics of surreptitious recordings, legal vs. illegal recordings, third-party recordings, surveillance systems and other areas that lawyers need to know as they receive and use recordings of witnesses.  The session will discuss the difference in the use of recordings in civil vs. criminal litigation.  By the end of the session, participants will be better prepared to prove their cases and protect themselves from allegations of wrongdoing.
