NOTE: If you previously completed the course, "Depositions 2020/Annual Convention 2020" and submitted your hours to the Virginia State Bar, you may not claim credit for this course, which was included in the former.

Few ethics rules specifically single out depositions as their subject. Yet, the ethics rules and LEOs have much to say about attorney conduct in the context of depositions. This program will flag where ethical authorities say deposition tactics are right or wrong, and when those authorities are indifferent. Topics will include taking depositions in another state, paying fact witnesses, discussing testimony during breaks, and the boundaries, and, in some cases the mandate, of deponent preparation (“coaching”). Attention will be paid to recent changes to the Rules of Court governing objections in depositions, in the context of the ethical prohibition on intentionally ignoring an established, black letter procedure governing conduct.
